These Terms of Use (“Terms”) govern access to and use of the ID Local website, mobile applications, broker dashboard, reports, related services and features (collectively, the “Service”). ID Local is operated by ID Elite Dev Inc., located at Laval, Québec (“ID Local,” “we,” “us” or “our”).

By creating an account, accessing the Service or using any ID Local feature, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and authority

You must have reached the age of majority in your province or territory and have the legal capacity to enter into a binding agreement. If you use the Service on behalf of a company, brokerage, agency, law firm or other organization, you confirm that you are authorized to bind that organization to these Terms.

2. Purpose of the Service

ID Local helps real estate professionals and other authorized users generate and share neighbourhood intelligence reports relating to a property address. Depending on the available features, reports may contain maps, nearby services, estimated travel times, neighbourhood indicators, demographic information, housing information and automated explanatory content.

Features, data sources, report sections and availability may change over time.

3. Account registration and security

You must provide accurate, current and complete information when registering and using the Service. You are responsible for maintaining the confidentiality of your login credentials, protecting access to your devices and promptly notifying ID Local of suspected unauthorized access.

Personal account. Each ID Local account is intended for use by the registered account holder. Login credentials may not be shared with another individual. The account holder is responsible for all activity performed through their account.

The email address used to sign in is the unique identifier for the account. The email address displayed in reports may be different from the account email. You are responsible for keeping both addresses accurate and accessible.

4. Professional profile and report attribution

A complete profile is required before a report can be generated. At minimum, the profile must include the user’s first name, last name, phone number and email address to be displayed in reports.

To protect report attribution and account integrity, certain profile fields, including first name, last name and report email address, may become locked after the second successfully generated report. Changes to locked fields must be requested from ID Local.

Each report may preserve a snapshot of the profile information that was associated with the account when the report was generated. Later profile changes may therefore apply only to future reports and may not modify previously generated reports.

You are responsible for ensuring that professional titles, brokerage or agency names, licence information, contact details and other profile content are accurate and that you are authorized to use them.

5. Client and recipient information

You may enter a client’s or recipient’s name, email address and other information only when you have the authority and appropriate consent to do so. You are responsible for confirming the recipient’s identity, the accuracy of the email address and the selected property address before generating or resending a report.

You must not use ID Local to send unsolicited messages, misleading communications or marketing without the consent required by applicable law. Consent to receive a requested report does not automatically constitute consent to receive unrelated marketing communications.

6. Informational nature of reports

ID Local reports are provided for general informational purposes. They are not and must not be treated as:

  • a property appraisal or opinion of value;
  • a building inspection, environmental assessment or title search;
  • a confirmation of zoning, permits, legal boundaries or municipal compliance;
  • legal, financial, tax, mortgage, insurance or investment advice; or
  • a guarantee concerning a property, neighbourhood, school, service, travel time or future condition.

Neighbourhood names and boundaries may be approximate or based on commonly used areas rather than official legal boundaries. Demographic and housing information may describe a larger statistical area containing the property and may not represent the exact property, street or neighbourhood. Distances and travel times are estimates and may vary according to traffic, route, weather, construction, access restrictions and other conditions.

You must review each report and apply your own professional judgment before relying on it or sharing it with a client. Users and recipients should independently verify information that is important to a transaction or decision.

7. Automated and artificial intelligence content

Some report text may be produced, summarized or assisted by automated systems, including artificial intelligence. Automated content may be incomplete, outdated, imprecise or incorrect. It does not replace verification by a qualified professional or an authoritative source.

You are responsible for reviewing automated content before using it in professional communications.

8. Third-party data and services

The Service may rely on third-party providers for mapping, geocoding, location services, census or statistical data, points of interest, travel estimates, hosting, email delivery, analytics and automated content generation.

ID Local does not control every third-party source and cannot guarantee that third-party information will always be available, current, complete or error-free. Third-party services may also be governed by their own terms and privacy policies.

9. Acceptable use

You agree not to:

  • use the Service unlawfully, fraudulently or in a misleading manner;
  • share an account or impersonate another person or professional;
  • submit information you are not authorized to use;
  • use neighbourhood, demographic or housing information for unlawful discrimination, prohibited steering or any practice that violates human rights, housing, professional or real estate obligations;
  • interfere with the security, operation or availability of the Service;
  • circumvent limits, access controls, payment controls or technical safeguards;
  • scrape, copy, extract or compile the Service or its data on a bulk or automated basis without written permission;
  • reverse engineer, decompile or attempt to discover source code except where applicable law expressly permits it; or
  • resell, sublicense or commercially redistribute ID Local data or reports as a standalone database or competing service without written permission.

10. Reports and permitted professional use

Subject to these Terms, you may generate reports for your professional activities and share them with their intended recipients. You must not alter a report in a way that creates a misleading impression, removes required source notices or falsely represents the report as an official government, municipal, appraisal or inspection document.

ID Local may apply usage limits, report limits, storage limits or other reasonable restrictions according to the account or plan.

11. Fees, plans and billing

Some features may be offered free of charge, during a trial or under a paid plan. Where fees apply, the price, billing period, applicable taxes, renewal terms, cancellation conditions and included usage will be presented before purchase and will form part of these Terms.

ID Local may change plans or pricing prospectively. Any material change affecting an active paid plan will be communicated as required by applicable law.

12. Intellectual property

The Service, including its software, design, branding, templates, report structure, original text, graphics and documentation, is owned by or licensed to ID Local and is protected by applicable intellectual property laws.

You retain ownership of information you lawfully submit. You grant ID Local a limited, non-exclusive licence to host, process, reproduce and transmit that information only as reasonably necessary to provide, secure, maintain and improve the Service, comply with law and enforce these Terms.

Feedback and suggestions may be used by ID Local without obligation or compensation, provided that personal information is handled in accordance with the Privacy Policy.

13. Privacy

Our collection, use, disclosure, retention and protection of personal information are described in the ID Local Privacy Policy. By using the Service, you acknowledge that information may be processed by service providers as described in that policy.

You remain responsible for your own legal and professional obligations when collecting client information and using reports in your business.

14. Availability, maintenance and changes

ID Local may update, modify, suspend or discontinue all or part of the Service. Temporary interruptions may occur because of maintenance, security events, provider outages, technical problems or circumstances beyond our control.

We do not guarantee uninterrupted availability, permanent storage of every report or compatibility with every device, browser or operating system. You should retain copies of reports and records required for your professional activities.

15. Suspension and termination

ID Local may restrict, suspend or terminate access when reasonably necessary to protect the Service or its users, investigate suspected misuse, respond to security concerns, comply with law, address non-payment or enforce these Terms.

You may request account closure by contacting ID Local. Certain records may be retained where reasonably necessary for security, fraud prevention, legal compliance, dispute resolution, accounting or the integrity of previously generated reports, as described in the Privacy Policy.

16. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.” ID Local does not guarantee that the Service or any report will be uninterrupted, error-free, complete, accurate, current, suitable for a particular transaction or free from harmful components.

Nothing in these Terms excludes any warranty, condition, right or remedy that cannot lawfully be excluded.

17. Limitation of liability

To the fullest extent permitted by applicable law, ID Local and its owners, directors, employees, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of profits, loss of business, loss of opportunity, loss of data or decisions made in reliance on a report or third-party information.

ID Local is not responsible for errors introduced by incorrect addresses, recipient information, user profile details, third-party data, automated content or the user’s failure to verify information.

Nothing in these Terms limits liability that cannot lawfully be limited or excluded.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless ID Local and its representatives from claims, losses, liabilities and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, your infringement of another person’s rights or information you submitted without proper authority.

19. Changes to these Terms

ID Local may update these Terms to reflect changes to the Service, business practices or legal requirements. The updated date will appear at the top of the page. Where a change is material, we may provide additional notice through the website, application, dashboard or email.

Continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms, except where applicable law requires another form of consent.

20. Governing law

These Terms are governed by the laws of the Province of Québec and the applicable federal laws of Canada, without regard to conflict-of-law principles. Any dispute will be submitted to the courts of competent jurisdiction in Québec, unless mandatory law provides otherwise.

21. General provisions

If any provision is found invalid or unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer your account or assign these Terms without written permission from ID Local. ID Local may assign these Terms as part of a reorganization, financing, sale or transfer of the Service.

These Terms, together with the Privacy Policy and any plan-specific terms presented at purchase, constitute the agreement governing use of the Service.
